I am going to have to sell my house for less than what I owe (short sale). The first mortgage will be paid off but the second is the problem. How does that work?? They are through the same company.

It is important to know alternatives to foreclosure. Thank you for this post. Quite often people facing repossession don’t know where to go and despite their obligations, mortgage are not always helpful and friendly.

The exact same thing happened to me. Everyone in the transaction, including the bank's loss mitigation agent (at Huntington Bank) said they wouldn't chase me for the balance, and 3 weeks later I had their collection agency after me. They also took $3,000.00 up front, in Aug 2008. Was your 2nd Huntington Bank too? What are you doing about it?

You forgot one thing, the Mortgage Debt Relief of 2007, signed by President Bush, which says that homeowners who short sales their houses, in 2007-2010, are not liable to be taxed. So it's a win-win situation, except for the credit reporting.

I sold my house on a short sale. I had 2 mortgages. The first mortgage has given me no trouble. The second mortgage agreed to take 3,000 dollars for release of mortgage, never stating that they were going to come after us for the rest until 3 months after the house sold. Can you tell me what my rights are? Thank you.
